State Specific Question About: MINNESOTA (MN)
I recently purchased a property on 5/30/13 that a tenant was currently under lease in. The tenant was late with her rent in the month of June so I told her that I was going to evict her. She went to Mid-Minnesota Legal Aid to get some assistance. Legal Aid sent me an email stating that due to the fact that I didn't have an rental license until 6/27/13, the tenant only had to pay me pro-rated rent from that day. Which I never heard of considering Mpls Rental License Agency allows you 60 days to get your rental license when you purchase a rental property. Which I did make that purchase within that allotted time frame. This should not effect my ability to collect rent. You run into new situations with every slick tenant. Anyone with state specific answers to this, please feel free to let me know regarding this matter. --66.41.x.xxx

Do not know about your specific situation but I do know those people will tell you anything and people believe them,as far as I would be concerned they are working for your tenant and not in your best interest,do the eviction,the only opinion that matters is the judge --24.92.xx.xxx

The agreement was made under a previous agreement so go to court and ask the judge to evict for non payment. --75.94.xxx.xxx

I am with V - when you purchased property the lease went with the purchase - ideally the tenant should have been notified of change of owner ship --- that the lease was being honored etc. that as of xxx date the rent check should now be made out to xxx - all terms and conditions of the lease remain.
You are not renting to her - she was ALREADY renting - a new lease was never written - let legal aid bully you - again I am with with - a notice to pay or quit - then fill for non payment - to proceed with eviction.
Tenant has already showed true colors by playing non payment game & consulting legal aid - time to find a new tenant who appericates your property and wants to make a nice home for themselves. --68.197.xx.xx

Larry, If your free legal aide is like mine, they will MAKE UP ANYTHING to get you off the clients' back.
They must take a course in "sound like an authority and people will cower in fear."

I agree with Brad. In my area the free legal aid are either wanna-be lawyers or actual lawyers who are too inexperienced or too awful at their professional to get a real job practicing law. They usually don't know what they are talking about. --76.19.xx.xx

ARRR matey.... they have shown their Jolly Roger.....now give them a broadside. It will be up to the judge.....but file for the eviction...also give them a 30 day notice of non renewal of lease .....let them know you will go for a judgement .....will allow you to garnish wages and hit them right in the credit report. Tell them because of their actions with the legal aid you will not stop until they are out. It may cost you some money (judge may not agree fully with your position). Did you do inspection with old landlord for condition of the unit when 1.tenant rented it and 2.when you received it.
Let them know they are walking the gang plank, it may take a little while but.....they are going over the end and into into the unknown shark infested waters with damaged credit report and your ability to attach their wages.

Ditto on what most are stating here ... Legal Aid lawyers sound authoratative, yell (or speak loudly) and try to bully people.
Do what you have to do and carry on. If it gets to the court/judge ... they'll decide.
