State Specific Question About: OHIO (OH)

Ordinance in Lorain, OH, Orders Landlords to PAY tenants water! Plus turn on fee, activation fee, etc. Landlords in Lorain (no other surrounding City) have to pay tenants water! Therefore Tenants Never Reimburse you, and use Excess Water! Bill grows larger ea. mo. Landlords legally CANNOT turn off tenants water for non-payment, Landlords legally must pay!! Cost to evict to get tenants to finally pay their water can be more than water bills, AND tenants aren't evicted! They get to stay and process starts all over again. This should be ILLEGAL! Around here I pay the water bill,if a 1 family it is in my lease that they pay it,if they don't the next rent check pays the water bill and then they are late on rent which I can start an eviction,that is also in my lease.You need to learn how to pick the right tenants and use proper techniques to get the desired results. --72.224.xx.x

Man, that stinks. Here's a few options:

1) Rally your local land lords and start a campaign to "evict" the stupid lawmakers who passed this ordinance. I'm sure some of the local big boy apt complexes are going to be hating this. They have $$$. Like it or hate it, $$$ influences politics.

2) Increase your screening standards. Explain to folks who have marginal credit you are sorry but you cannot approve them since the stupid law makers have made it possible for you to lose money with this policy. If they are irate, give them the name, phone number, and address of the law makers and encourage them to rant at these people.

3) Editorial in local paper saying basically what # 2 says, but blast it out there for the entire community.

4) Take extra large deposits from tenants who are marginal and/or have any utility collection accounts. Explain using info in # 2.

Where I am, I pay for the water because if the city can put a lien against the property if the water is not paid. So if the tenant doesn't pay, I am still responsible. It just saves me a lot of hassle to pay it myself. Raise your rents to meet the rising water costs. --50.23.xxx.xx

Here in nyc we have been paying water since the beginning of time. We are more than surviving but thriving. From 1992 we have been paying metered water, my water bills have been 50% less than before the meters came. Now with inflation they are about the same as flat rate in 1992.

Over the last 20 years, I've had a $10k, 6k, and 3k excess water bill. The 10k we fought and won and the other I had to eat. My 16 tenants are paying for that 9k in overage 10 times over in increases to mitigate this problem.

Pass these costs to the tenants in rent increases. You will win in the long run.

Here in Toledo landlords have to pay for the water bill. Our local REIA has tried to change this for years with no results. The best we can do is to state in the lease that we must be reimbursed for the water. Most of our leases state that payments must go first to the water bill, damages, fees, etc. before they are applied to rent. Some of us state that the rent covers up to xxx dollars of water bill and that overages must be paid by the tenant. --69.221.x.xx

This was discussed in Feb along with the inspections, those are next in case you did not know, I listen out there but most of my shacks are in CLE - for 20 some years we were able to use the HUD published water allowance and bill tenants for the excess but last summer sec8 stopped following this concept even though it is their sister team acting as the guidance counselor for the utility allowance cost system to be effective and because the big city court will not enforce the water bills added to the sec8 rent cycles those 2 systems are wilfully discriminating against the sec8 tenants, I have no control over how much water my tenants pour down the drain and the court could care less so I can not help you sec8 renters, complain to your system or become a straight pay renter. I do not pay water/sewer/refuse except in a few big places I can not get sub-meters into. --75.94.xxx.xxx

I suggest getting the HUD utility sheet, triple the allowance and add this to existing rent while installing faucet without sprayer - cut out outdoor water hose connectors - low-flow shower heads with anti-tamper gizmo, if questioned by tenant remind them you have your rent rated in accordance with new water saver equipment to save mayor xxx and council person xxx water for the next campaign, Maria will love hearing about this one... --75.94.xxx.xxx

I've had properties in Lorain for the past 25 years and had no problem with this.

My leases state that the tenant is responsible for water-sewer bills.

I pay the water bill,then add it on the monthly invoices in addition to the rent .

Tenant payments go first to water,then toward rent.

Should I need to evict I get a monthly readout from the water department and present it to the magistrate.If monies are still owed on water,the second cause judgement will include them.

Eviction cost is $125.for two people when doing it yourself and that is also added to the judgement.

For years I thought that it is law that LL has to pay the water/sewage bill, and I resented the only 2 separate meters for 2 sfh on one lot for extra yearly customer fee.

My lawyer just replied to my question, put it in lease, I can't wait till next tenants move-in and start adding water/sewage bill to their rent. --71.232.xxx.xxx

CA LLs had a law passed that said LLs are not responsible for tenants municipal utility bills - so I separate metered three complexes and have the utility company bill the tenants directly - no more surprise mega water bills or any water, electric, or gas bills! Get a law like this passed in your state - make sure it states ALL utility bills are the tenants responsibility if the bill is in the tenants name. --98.176.xxx.xxx
