So I get a call from a tenant in one of my doubles that the police issued a search warrant on the property and stormed in both units to do a search for drugs.

One tenant was at home but the other tenant was in the hospital at the time. Since the one tenant wasn't home the police busted in the front door and it needs to be totally replaced. They found no drugs or evidence of drug use. One tenant is a nurse and she told the police if she wanted to do drugs she'd get the good stuff (lol), the other tenant is a government employee and would get fired if she was caught with drugs and she assured me there was no illegal activity going on. I also did an inspection of the unit and found nothing to be suspicious.

So I was wondering if anyone has dealt with this and should I expect the city to pay for the replacing of the front door? Also, shouldn't they have contacted the owner of the building so I could've been there to let them in if someone wasn't home?

It is hard to have owner contact information unless you provide it in advance, however take a repair estimate to the police dept to be paid under victim relief fund, in this case a common door would have you the victim but the actual unit doors would be each of the tenant victims. --75.94.xxx.xxx

There must be more to this. How in the heck did the police manage to get a search warrant for BOTH sides of a duplex?? You don't just get to say "Well, we have evidence that it is happening at this address -- so we need to search both units!" That would clearly infringe upon the rights of one of the two.

I just don't get how they were able to obtain a search warrant for both units without probable cause that something illegal was occurring in BOTH units.

The affidivits on which the Search Warrant were issued are often NOT made public, under the rubric of "continuing nvestigation." I would nonetheless write to the police and demand a copy of the search warrants and of the affidavit on which they were based, and sumbit a demand for the cost of repairs. I would not expect to get anything, but I'd spend the time and the stamp to make the demand.

I would expect to get paid if they found nothing in the unit.They can't inform the owner,what if you were in on the dealing and you had someone inside to shoot the cops when they came in,you can't blame them for not wanting to tell you.I had a rooming house and had a drug problem and was cooperative with the cops and after a couple times busting in the door they actually told me when they were going in and I told them to contact me afterwards not before and after the first bust they interviewed an informant who was in there at the time and he told the cops that myself and my maintenance man kicked out the dealers whenever we were there. --72.224.xx.x

The police absolutely will not pay you one single dime no matter how bad they destroy the house whether they found anything or not.

The fact that some here seem to believe otherwise makes me feel like I should probably warn anybody who is considering reporting tenants to the police that it is a bad idea. The last thing you ever want is for your tenants to get busted in your house. --71.90.xxx.xxx
