State Specific Question About: MASSACHUSETTS (MA)

I rent a single family home to joint tenants and charge them for water. The water is in my name, I have low flow toilets, etc. only one meter since it's a single family dwelling. I did not get any certification or anything since no submeters are involved, now I have a tenant who doesnt want to clean up so even though he signed the lease that states they pay for water, he's hinting I'm somehow doing something illegal by charging for water. Anyone know if I need some sort of certification? I am tempted to just raise the rent next time the lease comes around and pay the water myself, but they use alot of water and I dont necessarily want to raise the rent. --128.223.xx.xx

Since this is a SFD (eliminates need for sub metering) under the exclusive control of the tenants and you have water saver toilets, showers, faucets, etc you can have the tenants responsible for their water use.

In MA most cities & towns won't let the tenants have the W&S in their names. Therefore you should keep the original W&S bill and pass along a copy to the tenants as soon as you receive it. If they don't pay it with their next rent payment (if you have a rental agreement like mine) you could apply the next monies received towards the W&S charges with the remainder applied towards the current rent. Then you will be in a better position to force them to pay or evict for non payment of rent. --98.110.xxx.xx

Actually I believe there is a state provided form that must be filled out where the landlord certifies they have met all the legal requirements in order to charge for water. --64.197.xx.xx
