Hi Phil... good post..
1. see if the law in SC governs pet fees... or are fees allowed and if so what type...
2. if so the next though would be that rental agreements 'follow the property' and thus survive a sale... that is they are independent..
3. so if some one paid a fee to have a pet... a fee being that one time charge... not pet rent.. i'd say it should transfer with the sale.. or a the least note that the requirement is satisfied with that payment.. until the tenancy ends --66.190.xxx.x |

My interp would follow OPM's for the most part. The fee (if it is a one time, up front, non-refundable) would remain with the original owner. If it's a refundable deposit, it stays with the property. If it's a month "pet rent fee", then all extra rent paid up to this point would stay with the original owner, and future pet rent fee payment would go to the new owner.
The law will be the primary method and the terminology used in the rental agreement to collect the money will be the secondary method governing how it is handled. An experienced closing agent should be familiar with how to handle deposits/fees/credits, etc, unless there's something really weird going on.
The only reason I bring up three scenarios is that people don't always use the words "fee", "deposit", and "pet rent" in the same way I would think of them, so I tried to cover all the bases. --108.250.xxx.xxx |

Here we charge a pet registration fee, this one time charge covers the cost of photo filing this pet in our own records and with our insurance who makes the final approval, each pet must be registered separately. At this time we limit with 2 pets each below 20lbs adult size. --75.94.xxx.xxx |

SC LL/Tenant laws do not address pets.
If you listed as a fee, it stays with you. If it's a deposit, it stays with the property.
Another good reason to use the word "fee".
I don't charge up front pet deposits or fees. I only charge an extra monthly fee. --141.129.x.xx |
