It is a tenant at will. They are hoarders I want to give them 90 days to move. I feel it better to just tell them I need the apartment empty. They pay their rent I just can't take it anymore. They came with the house when I bought it. --74.104.xxx.xxx |

With a tenant at will, you absolutely do not want to give them a reason. If you do, they could potentially fight you in court over your reason. You say absolutely nothing except that you want "possession" and you give them one rental period of notice.
If they move, great. If not, you will need to file for eviction and go through the courts OR bribe them to leave. --64.197.xx.xx |

You just need to issue them a Massachusetts 30 day notice. You should either go down to your housing court and speak to the clerk about getting the form and how to use it OR hire a constable to handle the whole process for you.
If they don't move willingly, you must then have a constable serve them with a Summary Process form and file for a court date. That doesn't always work in the landlord's favor here in MA. So alternatively, you may want to try and buy them out at that point.
P.S. Once you give them the 30 Day Notice, don't expect them to continue paying rent. Most tenants stop paying at that point and then disappear shortly after the court date is scheduled, leaving you in the lurch for numerous months of unpaid rent. --64.197.xx.xx |

Kay, presuming that their rent is due on the 1st of the month, you need to give them written notice that you are terminating their MTM tenancy. This notice must be in writing, must be for a whole rental period and must be given to the tenant prior to the 1st of the month. If push comes to shove you will need to prove that they received the notice & when they received it. In MA you can hire either a sheriff or a constable to serve them.
DO NOT give them 90 days in your notice, they will only ask for even more time. If asked by them or anyone else your reason for removing them is that you have other plans for this unit. You do not have to tell anyone what those plans are.
If they do not move at the end of the rental period, you will have to have them summons into court. More than likely the court will give them some additional time to find a place. However DO NOT volunteer to allow them to stay.
Another option to consider is offering them cash for their keys. Basically you offer cash or perhaps some assistance moving their stuff to speed things up. Remember they DO NOT get the cash until after you are given the keys back. --98.110.xxx.xxx |

Dan summed it up pretty good. Cash for keys is good idea, eviction lawyer will cost you about $1000.00 and will take longer than cash for keys. Do not give up a penny until you have keys and statement signed by tenant that they have given up possesion. --198.228.xxx.xxx |

I'm dealing with the same problem, Hoarders. They have started to clean & have till Monday. I did talk to local fire chief & he said that if it affects the safety of other tenants, they will fine them & I can give them a 30 day notice for any damages. --24.235.xxx.xxx |

Here hoarding would be considered impairing safety of the other tenants. The best way to start by contacting a landlords association where one can google to find a association near the rental. All paper work must be correct which can be supported by taking pictures.
