State Specific Question About: PENNSYLVANIA (PA)
What do I do with the security deposit for a tenant that didn't give a forwarding address? I sent a letter to the property address after tenant moved out with forward service stating that i need to send him the balance of his security deposit and statement if charges. It did not get returned which means he filed a forwarding address with USPS but he has not responded with the new address. Now what? --151.213.xx.xx |

Send the check and security accounting certified to the address and if it gets forwarded good and if it comes back to you do not open it and that is your proof you sent it to the only address you had,do not open it in case he sues you,then you can prove to the judge you sent it to him --72.224.xx.x |

What was necessary was for you to sent the accounting and the refund (if any) to the tenant at the last known address -- and if that last known address is the vacant unit (or a newly occupied unit), that is fine.

Technically speaking, per PA LTL, "Failure of the tenant to provide the landlord with his new address in writing upon termination of the lease or upon surrender and acceptance of the leasehold premises shall relieve the landlord from any liability under this section." -make certain YOU are blameless; you have done everything in your power to fulfill the law.
-It can take a long time for mail to bounce back undelivered.
-Even with the law Steve mentioned, most courts hold the LL responsible for errors, with fees, denials, etc, and do nto hold the tenant responsible for his mistakes, such as nto providing forwarding info. --67.175.xx.xxx |
