State Specific Question About: NEW JERSEY (NJ)

Had a tenant who was locked out. He picked up his belongings a few weeks ago/police supervised as he was a very violent man.

I am now suing him for the damages to the apartment. I have all the paperwork, receipts, pictures and video. The one thing I dont have is his forwarding address. I did the Return Service Requested on an envelope I mailed to the original address and it came back with a PO Box, which I cannot use for court.

The only other information I have on him is his part time employers address. Do you think I can use that address for the court documentation? If not, anyone have any ideas on how I can get this info? --24.44.xx.xxx

See this page of the USPS Handbook:

And, more specifically, see the "Process server" section -- and see "Exhibit 5-2b. Change of Address or Boxholder Request Format — Process Servers" that goes with it.

Basically, if you are trying to serve process paperwork and only have a POBox, you can request the physical address that goes with it. Note that the form letter even has a spot where you can say that the requester is a "party representing self" -- so I BELIEVE that you can do this in your situation.

It used to be much easier to get the physical address from a POBox holder -- you just had to have a "business relationship" with them. Now you have to be trying to file legal paperwork or have a subpoena.

Do you mean where to serve a summons?

Check your state law regarding Civil Procedure to see if (in whatever court you want to sue) you can serve the summons at his place of business.

Had similar situation - had my sister in sweet voice call work - got chatty with girl who answered phone at auto place where tenant work.

Said looking to send invite to surprise party not sure if he can get mail at work could you give me home address and the girl did.

Sometimes you got to get creative - are there any kids - lot of schools have PTO lists - church's pulish address books .... does tenant belong to any clubs - think sometimes a little creativity goes a loong way

I used this form before (Change of Address or Boxholder Request Format — Process Servers) and it came back with 'no physical address provided' written on the form. I guess the person getting a po box doesn't have to provide a physical address? You may be out of luck with that form if your tenant does the same thing. --174.49.xxx.xxx

I phoned the courthouse. They said I can submit the claim with the PO Box address and the envelope that I sent requesting the forward address which shows that the new address is a PO box. Hopefully that works. --24.44.xx.xxx
