State Specific Question About: NEW YORK (NY)

I have a section 8 tenant who has not paid her share of the rent for the past 4months.

She keeps pretending that she will do so and now she simply avoids me or pretends not to be in residence.

How can I get my money?

or get her out quickly?

How much of the total rent is she supposed to pay?

If she hasn't paid in 4 months, she never will. Is her portion low enough that you're willing to forget it?

Contact the Section 8 office and tell them she's going to be evicted for non-payment. (put it in writing) They should call her into the office & threaten to kick her off the program.

Contact an eviction attorney if you've never evicted before, and get started with your 3-day notice (or whatever is required in NY) --75.36.xxx.xx

Exactly what Lois said.

I once had a Section 8 tenant whose portion was low enough that I was happy with the Section 8 portion alone, and I never said a word about non-payment by the tenant. I think that tenant was supposed to pay about $50 per month, while Section 9 was paying me $950. Now, I would have preferred getting the entire $1,000/mo, but $950 was good enough!

That reminds me -- I once had a Sec8 tenant where her portion of the monthly rent was $4! Wasn't worth the time to deal with it even. I told her to forget it and that I'd appreciate it if she vacuumed the shared hallway now and then. Was a great deal! Can't beat hallway cleaning for $4/month! :)

Most juridictions have a threshold for what is considered non-payment of rent. In the province of Ontario one dollar in arrears is considered arrears of rent where one file for a eviction. Try to contact a landlords association where one can google to find a landlords association near the rental. One will need advise on how to procede with a eviction. --74.220.xxx.xx
