State Specific Question About: MASSACHUSETTS (MA)

evicted tenant moved out on there own. they had their brother move 90% of the possessions to his house. what can i do about the remainder and how long d i have to wait to remove it. --76.19.xx.xx

You can wait for quite a while. Make sure you get your attorney's blessing in the way you do it.

I made a mistake couple years ago that cost me $600 and a lot time. The stipulation said that they are out on certain day, as almost all evictions, clothes, toys, falling apart furniture are always left behind. I hired a guy, paid $400 to clean out 2 floors worth of stuff. She complained to my attorney that we threw away her passed-away child's wheelchair that tucked somewhere in the bathroom which I didn't even see it, valued $20K, a portable wheelchair. (We sent flower to her family when the child passed away)

With my attorney's help,(he helped put the tenni at another slumlord's apt, a small city) I agreed to pay one month rent at her new place and put the things behind.

Here we are supposed to get the keys left behind or a returned certified mail as proof of abandonment. That's why "cash for key" with a signed statement from tenni is so much better than full eviction. My attorney made it little easier, take plenty of pictures and store away anything remotely valuable (borderline self-help eviction), LOL, from my attorney's mouth.

99% time, you walk into a mess, clean out, life goes on. 1% gives you 99% headache when things don't go the usual way.

You should've had them sign a release saying they've taken all their stuff and left nothing but "trash". Short of that, you are supposed to continue with the court case to evict technically because they could be construed as still living there.

In the real world, you send someone in to throw the left behind junk away and then you if the court gets a complaint from the former tenant, you say "except for trash, it was empty when I got there." --76.19.xx.xx

I'd build evidence of "abandonment".

Utilities still on?

Dishes in cabinet or sink?

Food in fridge?

Mail being forwarded?

Bed in bedroom?

If you can reasonably prove abandonment, I'd change the locks and post a notice on the door "Dear xxx, please call me at xxxxxxx to retrieve the items in the apartment you left when you moved out"

Have you contacted them since they moved? Did you ask for the keys?
