State Specific Question About: NEW YORK (NY)
i have recently taken to court for non payment... the case was adjourned because they want to get their own lawyer... i have a 3 family home with one meter... this particular tenant has been leaving the water on all day and night spiking my water bill... how can i prove to the court it was them(i know it is)
i am not looking to install a separate meter for them... it is bad enough i am not getting my several thousand dollars in rent and now they are wasting my water and now i have to pay mortgage out of my pocket.....
how can i prove it is them to the courts???? showing previous bills to the court will not help my case at all

How do you prove it? Easy, just take the past bills and the recent ones to court and show it to the judge, I am sure he will be able to tell the difference. --64.134.xxx.xxx |

Don't bother,when you are in eviction court for non payment of rent the only thing that matters is that they owe back rent and you want them out now.Stay focused on thatand don't allow them to drag the discussion into how you never fix anything because that is where they will try to take it.I would bring up the water waste only when the judge decides you win and is discussing how many days extra he will give them before he will sign the warrant --72.224.xx.x |

Agree with Ken NY ... stay focused in hand. The tenants will bring it up ... and the judges typically will expect it. This is not a new thing for them. Tenants all say "nothing was fixed". If there was something wrong, bring copies of your bills/statements showing everything that was fixed to court. DO NOT BRING IT UP BUT BE PREPARED.
Keep the conversation on the fact that they did not pay rent. That is why you are there. Keep your mouth shut in court unless the judge is speaking to you. Take notes if you have to but don't say anything as they are speaking.
