I need my tenant to provide a copy of the lease. My copy was destroyed and I need to update my records. The tenant is not being forthcoming with the contract, only verbally assuring me when the lease terminates.
Am I forced to file case?

The tenant is not required to provide you with a copy of your lease. I would imagine that if you have to sue the tenant without your lease, the judge will rule based on the State law and a month-to-month lease. If the tenant appears to contest based on a lease, the judge will expect him to provide said lease, and at that time you should receive a copy.

So many seem to have this same problem,
Here is the solution...
Email the tenant a copy of the lease and yourself at the same time...
File it in Google Mail..
14-120 14 year ending..120 property address.
also copy deposit checks and applications include all in the email..
Keep all email communication in this file, very easy to find. next lease new file,15-120 Simple..you can do photos the same way..
Google is FREE...

Patrick, what is it that you need from the lease?
You should have a blank original or digital file that you started with.
Your rent ledger will show when they paid you and how much.
The application will show their names, etc. (oops! Probably with the lease!)
Each summer we send out a blank app and ask people to "update our records".
A little crazy but I'd do this: send him a letter stating he owes $___ in unpaid rent. When he calls to disagree say SHOW ME IN THE LEASE.
