State Specific Question About: NEW YORK (NY)

How do you complete the eviction forms for NYS for an LLC?

The judge dismissed my case today because I filled it out with my name.

I'm not a legal expert in NY or any other state, but in Missouri you have to have a lawyer represent your LLC. Your judge is a legal expert in NY, and if he said you can't fill it out with your name then he's probably correct. --108.250.xxx.xxx

Do a search here for "LLC" and you'll see that this is one of the reasons that they are often recommended AGAINST. Remember that LLCs are NOT designed to "limit the liability" of a managing member -- which you clearly are. In my opinion, your LLC is likely fairly pointless unless you have non-managing members that are involved from a financial standpoint, but not a decision-making standpoint.

Of course, hindsight is 20/20 and that doesn't help you much NOW. I'd recommend that you hire an eviction attorney to take care of it this time around. Then, when it is done, get a real expert (i.e. not some guy that makes money by recommending the creation of LLCs) to look at the situation and see if getting OUT of the LLC makes better sense.

This varies greatly by state. I don't know NY.

In NY if the property is owned by a LLC you fill it out as the LLC as the owner.How did the judge determine the LLC owns it and not you personally.Yes you are supposed to have a lawyer represent a LLC but many judges don't enforce it.I suspect there is more to the story and would like to know how the judge made his ruling,Did the tenant bring it up?Also what court were you in?Give me more info,I do quite a few evictions for myself and the paperwork for other landlords also. --72.224.xx.x

Ann I would be surprised if the judge looked it up,that is not there responsibility,it would be up to the tenant,actually it could be argued that the judge is showing bias toward the tenant if they did that.What city and county is the property in,maybe I can giveyou some pointers?Have you hired an attorney? --72.224.xx.x
