State Specific Question About: PENNSYLVANIA (PA)

The lease ended last year for our tenant in our property. I

sent a new lease in the fall for her to sign but she never got it back

to me. I kept asking but there was always a reason why it wasn't

back yet.

Anyway,there were family problems and she didn't pay January or February's rent. She is in the process of moving out but isn't sure when she will be done. I told her that we need her out by the end of February and would be changing the locks so that we can begin to paint, clean, etc. since we've decided to sell rather than rent. She told me she'd let me know when she was out and that we couldn't legally change the locks. Is she correct in that assumption? Why would we not be able to change the locks when they have been living there without a current signed lease? What are a landlord's rights in this

Honestly, you sound more like a tenant posing as a landlord. But, here goes anyway.

No, you can't change the locks. The reason? It is against the law in all 50 states. believe there is a twist to that in TX, but you don' live there, so it doesn't apply.

You must go through the proper eviction procedure according to the laws of you your state. Some local governments may impose some additional requirements.

You say there is no lease, but that does not matter. With no lease, you have a month-to-month rental agreement that contains the same terms and conditions as the expired lease, just with a different time period. The tenant is in breach, because of non-payment of rent. But it is up to you to enforce the lease, which is through the proper eviction procedure. --65.23.xx.xxx

File for judgement based on unpaid rent, this way you recover your property in about 30 days, then you change locks - should have acted the day after the rent was due, this is why others will advise to sell - you do not read tenant business law. --75.94.xxx.xxx

Start the eviction now,that will start to put pressure on her and push her out.You can't just kick her out for the same reason a bank can't just kick you out if you don't pay a mortgage,you have the right to stand in front of a judge and prove you have paid and so does a tenant.Find out where she works and garnish wages --72.224.xx.x

Set a firm date, in writing that she agrees to be out. Like this weekend!

Should have been the day she decided not to pay January's rent.

A 36-year-old Sheppton woman is in Schuylkill County Prison on charges she tried to hire a hit man to murder her landlady, who was in the process of evicting her.

East Union Township police Chief Tony Harris said Jamielynn Reilly was arrested Wednesday for trying to hire a man to kill Kelly Feeko and her boyfriend, Brian Treco.

According to Harris, Feeko had asked Reilly to vacate the home she was renting from her at 885 Center St. by the end of the month because Reilly had changed the locks and had not given Feeko copies of the new keys.

Harris said he learned of the incident when Feeko came to his office Tuesday night "and told me a hit had been put out on her."

After investigating, Harris contacted the Schuylkill County District Attorney's Office and county detectives got involved.

Court papers show Feeko learned of the plot from the man Reilly tried to hire to kill her, identified as Rafael Lopez.

A sting operation was set up in which Lopez consented to troopers recording Reilly's telephone call to him.

When Reilly called, Lopez said he had obtained the services of "Blue Boy," the hit man who would do the job, according to court papers. "Blue Boy" was an undercover county detective.

"She told him how she wanted it done. She wanted Kelly killed first, so Brian could see Kelly killed," Harris said.

During the telephone conversation, the undercover detective told Reilly, "We'll take care of this for you." Lopez told Reilly he didn't know where Feeko lived, and Reilly said, "That's why I kinda want to be with you."

Lopez asked Reilly if she wanted two other people, identified in the court papers only as brothers Richie and Larry, "wiped out or what." Reilly said to leave them alone.
