State Specific Question About: OHIO (OH)

I was granted an eviction, but have not seen the tenant in two months plus. On the eviction date, I had to move all her furniture, clothes, etc into the basement, because my city doesn't allow it to be put on the curb. Someone also told me that I'm responsible to take care of this property, or pay to put it in storage. (Which I refuse to do). My question is how do I dispose of this unwanted collection, and how long do I have to keep it in my house ? --99.88.xxx.xx

I would expect that you would be governed by State Law. there are plenty of OH people here that can answer competently.

I might suggest a Certified Letter to the T's last know address [your place] and them [if they will have it] consigning the lot to a local auction.

You could charge the cost of delivery to the auctioneer & their records would serve you well if the T was to holler about it.

SOMEONE TOLD ME.....geez you went thru an eviction and cannot ask those at the Court where you were granted the eviction what the rules/laws are?

Maybe even your atty?

This should not be so hard.

In NY state each Sheriff makes the rules as far as where to store it,put it on the curb ect,so maybe you need to call them --72.224.xx.x

Most jurisdictions have a time limit on how the landlord has to keep the tenants belongings left behind. In the province of Ontario after the sheriff has arrived the tenant has seventy two hours to recover their belongings. After that the landlord can sell or dispose of the belongings. Find out what the time period is. If the time period has passed then the right thing to do is to donate usable items to charities and furniture can be donated to Habitat for Humanity restore. What is broken or unsanitary can thrown out. Many towns have clothing donation boxes or drop off at the Savation Army stores. Try to contact a landlords association where can google to find one near the rental who will know the time limit. --74.220.xxx.xxx

Depending if your local court ruling of abandonment is different than state law, OH is a 30 day abandonment.

This also applies to the security accounting statement, the clock starts when you get the writ of restitution or the keys returned, whichever occurs first, I would resolve this by having the court approve any property left is considered abandon - this goes on the record, ask your judge for this next time. --208.90.xx.xx
