Can a landlord legally state an occupancy limit for a particular unit?

(I have a 300-square-foot efficiency apartment that couples keep moving in and out of because it is too small. Also have a small house that I'd like to set a 5-person limit for.)

I would up the rent or advertise it as Micro-Living. Figure out another way to screen and disqualify. You are smart to try and lower your movein/out rate. Perhaps provide a storage shed, so they have a place for all their extras, maybe they would stay longer?

Up the rent on the small house, change your screening criteria. I have a three bedroom house that I adveriste as a two bedroom to draw the approiate number of people... they are always pleased and surprised to 'find' the extra space!!!

We have an efficiency where we specify it is for a single occupant. If the HUD recommendation is Bedrooms x 2 plus 1, then the efficiency occupancy would be (0 x 2) + 1 = 1 occupant. --63.81.x.xx

As the landlord you must set limits to avoid problems like quick turn overs. In my case I was accused of discrimination.

I have small single apartments in a popular area of the city.

The people that rent are a notch above illegal or undocumented, where as they have a work permit or visa. Marriage, what's that? Birth Control, never heard the term before! They keep popping out kids like the our Government give aid based on the number of kids you have under the age of 18. Oops, they do! When these tiny units have a mother, the babies father and an average of 5 kids and is far over crowed, the government expects me to pay $18,0000 per unit relocation funds to the families.

Instead I limit the number of people I will allow to live there. After a couple of births I raise the rent 10% per child, allowable by law. Soon afterwards they price themselves out of these affordable units. --173.60.xx.xxx

Fire chief can answer this question, also HUD will offer the room sizes 70sq ft = 1, 120sq = 2 person sleeping room, never any gas burning appliance next to any sleeping room - this was overcome when closets came into vogue after the

depression, the older homes had 1 large closet next to the bathroom, those homes had generous closet space on the ground floor for off season coats, shoes, boots. --75.94.xxx.xxx

Based on septic tank capacities for me - Health Department says 2 per bedroom. Efficiency equals 1 person. I state in my ads, "One Human Occupant per unit!" as I do allow pets. --50.82.xxx.xxx
