I have a tenant that is a late pay (only one thank goodness), but for me it is one too many. If I file eviction for non-payment of rent, will I be forced to accept rent even if I prefer to just get rid of these people & get a better tenant?

I know a lot of landlords take a different approach, but I don't like this constant hassle every month. I know many will say "it's part of the business", but is it really, or is it a tough choice most people won't make?

Any help on the exact question about just tell them they are not going to be staying since they did not pay on time will be appreciated.

This home is in Tarrant County but goes to the JP in Mansfield TX.

Send them a bill, and include an envelope to mail it back to you.

I have college rentals and they mail it to my Attorney, I hope they get the message...

Chase bank will give you a debit card and they can deposit the rent even cash. Each card has an ID so you can track it..no charge..

When you send them a bill add the last months late fees on there, and shake them up a bit...work for the Credit Card Companies...

Good Credit will give most of us $10,000.00 a year free money...bad credit bank will not loan to you... --98.253.xxx.xxx

Unfortunately, if they pay up prior to eviction (including all your fees you incur) you have to keep them.

But if you start the eviction process with a "right to cure" letter, at such time as provided for in your lease and in the manner stated by your state, then they will know you mean business. We normally send an email with an exclamation point about late rent and then set forth that we need the money to pay our bills on or before the first and that even though we can't charge late fees until the 14th (which is the case in Maine), we still consider it late as of the first.

Then they know where we stand and usually after this approach we get it by the 3rd at the latest. Still unacceptable but more tolerable. --71.254.xxx.xxx

Yes only one late pay, but I have lofty goals of no late pays. :-)

I always send a 3 day notice on the 2nd day if they have not paid on the 1st. This tenant has received a 3 day every month except the first month they were in the home. I filed eviction at the court yesterday, still no rent paid. If they pay enough I will keep them to collect late fees & court fees, apply the rest to the rent, then start over. If they try to pay a small amount, I will return it to them. I am not planning to spend my time on this merry-go-round very long. Appreciate the replies.
