These should be listed on the lease and carry a fee, everywhere around me charges 25bux for the opener - they must buy in bulk cause they often cost me 32 and up. Good thing is you can reprogram the old one away with the push of a button. --75.94.xxx.xxx |

Not returning the opener: like the key, legally, permits access to property, so like a key, it means that they have not surrended the property. That was my question. If that is so,

I see it as a grey area solved by pro-active managing.
Call them and ask. No answer? Go look inside the home. No need to be shy.
If they have obviously vacated the property this is probably a matter of forgetfulness or a lost opener. Many people leave the opener in the kitchen drawer, OR accidentally drive off with it.
I would not ask MY judge for extra rent based on this.
If they still have items in the home, they still have possession. take some photos to document their continued use of the home.
Our lease states $75 to replace a clicker.
Clickers always concern me. The next res can complain they were robbed because *I* did not change the code like we change locks.

Yes, I agree that the clicker can cause trouble. Can't the new tenant change the code after moving in? I change the locks, of course, but there is no way they will believe I changed the clicker code.
Anyway, even if they are gone, doesn't it mean that they are still in possession if they don't return the key(s) and/or the garage door opener(s)? --24.94.xx.xxx |
