State Specific Question About: FLORIDA (FL)

I showed a unit to a Section 8, single Mom of 3, today. She works part-time, and has subsized college funding. When I gave her the application, I told her that "I need the last 2 years tax returns to verify income". She told me "I don't think I need to provide that to you". I told her that all the tenants living here provided proof of income, and in order to accept her app., it will be provided. Other than the baditude, what's the deal with a Sec 8 not wanting to provide tax returns? I know, NEXT! --72.40.xx.xxx

It could be you're asking for more than your competition asks for. For W-2 employees, I only ask for last two pay stubs, and current employer must confirm 1 year on the job. If less than 1 year, past employer must confirm a minimum of 1 year on the job. I don't look at tax returns except for self-employed.

For Sec 8 and subsidies, I would just confirm how long the subsidy is good for. Generally speaking that's enough without seeing a tax return.

Then again, none of my units are Sec 8 approved, so it's a non-issue for me. --108.250.xxx.xxx

I ask it of all self employed, contract workers. The salary varies from week to week, ect. Pay stubs are required of permanent employees. Of course, the HA has that info.,so I don't get why they would refuse to provide it to a landlord. --72.40.xx.xxx

When I get challenged by an applicant they just screened themselves out,I am looking for compliant types who understand the pecking order,that being said I only want last paystub and don't bother to speak to the employer.Someone on section 8 I need to know how much they will be paying and want to see the ability to pay that amount --72.224.xx.x

As long as you ask everybody that you application to, you are OK. If they don't want to give the information then I would not rent to them.

The law says that you need to treat everybody the same.

By the way have you had your property inspected by sec 8? Do not let a sec 8 person move in until your property has been inspected and approved by sec 8.

In the first post, you said that she works "part time" -- you didn't say that she was "self-employed" or a "contractor". So -- which is it?

If she works "part time", then shouldn't you be asking for pay stubs (like you said that you do) and not 2 years of tax returns?

Don't get me wrong -- I agree with asking for tax returns for self-employed people. It just doesn't sound like she is one of those people.

She works varied hours per day, and varied number of days per week. In other words, she works when the job and hours are available, and accommodate her schedule. I'm guessing approx. 12k to 15k a year of earned income. According to her, Sec 8 provides her a voucher of up to $1,200 a month. --72.40.xx.xxx

First thing to do is take the free class on sec8 and discover if it seems like they answer your questions, verify part-time income seems fair to me however be sure you do this with anyone working -part time- to avoid the discrimination question. It is good you screen sec8 because I have recently had 2 sec8 people mispell thier name to me and sec8 but have felony backgrounds - used family member name and id to sec8, caught him on the part time job and supervisor said he think I am looking for his brother - oh the can of worms that held, they both work for the same company.

But be sure about your housing office because there are some real scammers out there on sec8 along with some wonderful tenants I have had over 10 years. --75.94.xxx.xxx

Personally, don't see where you would be the one with the baditude. You treated her just like you treat everyone else. And what is wrong with wanting/doing all you can to protect your investment.

Keep in mind generally with section 8 what your doing is irrelevant. They will not make enough income to garnish wages. But, they will loose their benefits if evicted for non payment of rent. It is rare that a Sec. 8 recipient doesn't pay their portion. To much to risk.

What you really need to be concerned with is how is she going to treat your property. Will she keep it clean, be friendly with other tenants, not have extra people, cooperative with repairs etc. That is where I would rec. you focus your attention on instead of her income. They won't approve her for your place if she can't afford her portion of the rent. --71.176.xx.xx

V OH, Yes, I'd like to take the class on Sec 8, I didn't know there were any offered. I'll check into that.

I was under the impression that all enrolled in Sec 8 were screened for evictions, and could pass the criminal record check. It's a real challenge here to get the tenant approved, do the inspection, and get the Sec 8 rent money for the 1st without holding a vacancy for a month. My Bible is in the mail.

I did a check on one Sec 8, and it appears that there was an eviction a few years ago. The tenant denies having any prior evictions. --72.40.xx.xxx

Ask at the sec8 office about a seminar for landlords to be familiar with the documents-eviction process-pet policy(do not allow any pets because there is no recovery)-inspections.

Amazing how a background check shows the stuff missed by sec8 check, my opinion of the sec8 background check --> if they are here at the office they are not in jail so all must be good, passed. --75.94.xxx.xxx

I found some articles on Sec.8 applicants where the applicant turned in a different amount of income to the IRS than what they provided to Sec.8. So...it was fraud and they lost their voucher.
