State Specific Question About: NEW JERSEY (NJ)

Tenant just moved in and is complaining that something in the apartment is making her allergic. Says she had to go to emergency room and is taking steroids. She is seriously allergic to cats and there was a cat in the unit before her. Carpets were cleaned and drapes were removed. She is still sick one week after the cleaning.

She mentioned the discolored(light black) caulk in bath caused by mildew but had been bleached. She also mentioned a ceiling exhaust fan. And that the carpets (two years old) may make her allergic. What is a landlord to do? --173.63.xxx.xxx

This early in the tenancy, I would tell her politely that you want all of your tenants to be happy in their apartments and if she finds that she isn't happy in the apartment, you will accept a written notice from her and let her out of her lease. Let her make the decision. She'll be happy or shell be paying to move. DO THIS NOW or you will have a constant barrage of complaints. Request all repairs be made in writing if she stays and let her calls go to voicemail. --70.44.xxx.x

It's really difficult to get cat dander out of carpeting.

She should really be in an apartment with NO carpet.

My son is seriously allergic to cats, having been hospitalized when he was young. Even as an adult, he avoids being in homes where a cat is or has been.

You might try cleaning the carpeting again; but I would consider releasing her from the lease if that doesn't help. --99.18.xx.xx

Acknowledgement of the premises, clause is need in your lease showing they have inspected the premises and examine the premises prior to occupying the rental premises prior to the Rental Agreement, and have found it safe, clean, livable, and habitable

Greg, I would be a little careful of tearing out carpets and putting in hardwood just to appease her. I would get a higher rent or increased security deposit for this service. Reason being is to stay in control of the situation and her demands. Your reasoning for increased monies is to return the apartment to its original condition when she moves out. Hit her pocketbook and I'm sure she will accept that carpet pretty quick. --70.44.xxx.x

Greg,

Wow! another example of why carpet is NOT good for rentals!! I think someone posts an example every day!

In our 36 years of LLing, we've never seen soooo many people with respiratory problems. Even in new houses!

Who shampooed the carpet? Was a a professional truck mounted steam extraction? Might ask him to return and repeat. Did he use an odor treatment that left a residue? Puny little rental machine that did not have adequate suction?

It's all about heat and suction.

This lease will not go forward. She has mentally checked out. I'd end it and let her move on. Not worth the court battle nor the bad press.

Good residents are hard to find. If you were planning to replace the carpet (with a hard surface of course!), could be worth doing that before she moves out.

We are starting to replace carpet, if for noting else a quicker cheaper turn over.

The sad thing about SD, is when it is gone so are your chances of being paid for the damages done.

Surely, you must let her out of the lease.

She might be a pita person and nothing you will do will satisfy her. How come she didn't have any reactions or say anything about her allergies when she was looking over the apartment in the very beginning?

Most people with allergies will not want to rent with any rugs in the apartment. I've had prospective tenants tell me that up front.

Also now she will be complaining about mold seeing as how she didn't like the bleached caulk.

I would tell her that you are so sorry that she and the apartment are not compatible and that you are giving her the money back because you don't want anyone to be unhappy in your premises.

She really sounds like a person who will always find some fault even after you bend over backwards for her.

If she "doesn't want to move" or "really likes it here" or "wants other options" (all phrases I have had tenants use), I would offer to remove the carpet and pay for 1/2 of allure flooring for her (she can pay for the other 1/2). I too would let her out, regardless of why she's complaining. My son was HIGHLY allergic to cats when he was young and it indeed sucks. Don't think you can get the place clean enough to satisfy her if she's truly allergic to cats and you had one in there previously. I'd just let her out of the lease and make it quick and painless for everyone. I don't think there's a need to rip out carpets right now either, but I would CERTAINLY add a question to your application that inquires about allergies to any animals/pets, so you avoid this in the future. I too have carpets in my two units, but given all I've heard about Allure on this forum, I will give it some serious thought when it's time to replace the carpets. --173.23.xx.xxx
