State Specific Question About: TEXAS (TX)
What are the rules about refunding rental deposits? I have a prospect tenant sign the rental agreement after completing the application. He paid a $400 deposit to hold the rental and then was going to pay the rent of $750 to move in on Janury 5. He called to say he couldn't afford the rent and wants his deposit back. How much refund do I owe him? I missed out on other applicates for the month.

What was the agreement between the two of you regarding the deposit? What documentation is there about the agreement?

What does your rental application and lease say?
Mine states that there is a good faith deposit of 100.00 to hold the unit for a period of no more than 14 days while the credit and background checks are done. Also, if the prospect does not qualify, deposit is refunded. If qualified, deposit goes toward 1'st months rent. If prospect backs out, deposit is forfeited. If your applicant signed the lease, then he is bound by the terms of the lease. At that point, you may refund some of it as a goodwill gesture, but that's up to you. Might be better to cut him loose and be done with it, then be stuck with a tenant who clearly cannot afford the rent. --70.173.xx.xxx |

you owe him nothing, he owes you,
you can use the security deposit towards rent due. tell him he still owes balance of first month but you will release him from contract but will keep the $400 in exchange. he signed contract. Don't feel bad. --97.94.xxx.xxx |
