State Specific Question About: NEW YORK (NY)
wonder if others had this happen, first time i had this happen in15 years, of course my fault not proacting for the holidays.
I had a tenant say they would pay and of course giving the benifit I waited, Served them a 3 day pay or quit, but at this point the courts are on holiday, and i'm afraid they won't get back until the new year. so my question is now this guy is going to owe me for the following month, do you serve him again (3 day pay or quit) with the updated charges for the following month or just ad the new charges when I have someone serve the petion for non payment?

I would take 10 minutes of my time and phone your dead beat tenant. Ask him if the check got lost in the mail, if so can he drop off a cashier's check on Monday, banks and local corner stores are open issuing money orders.
Then wait until the 26th and file using your old 3 day notice with the lesser amount. Or you could issue him a nother 3 da notice on Monday, and on Friday file your case...... --173.60.xx.xxx |

I find it very hard to believe your courts shut down over the holidays. If you call, I'd bet they're working first thing Wednesday morning. They are like any other 'business" - they may get off a little early on Christmas & New Year's Eve and certainly Christmas and New year'sDay but that's it.
Don't know how your state and notices work, but if I needed a notice of the exact amount, at this point I'd wait until January 2 so I could file for two months. --72.95.xx.xxx |
