I have a tenant who wanted to leave, put a deposit down on another place. Filled out an app for them. That's it. One day later changed his mind, wants to stay. New LL won't return deposit. I'm thinking small claims court? --75.53.xxx.xx |

suppose he signed a paper that reads Holding Deposit, not refundable? Or he signed a lease, or what papers did he sign. --173.143.xxx.xxx |

Only signed an app, no lease, I was meaning HE could go to SCC, not me. --75.53.xxx.xx |

It's up to him. But I think you have lost him because it would take too long for a result and he will probably just stick with the first place. Forget him, move on. --168.7.xxx.xx |

Why are you in the middle of this? As long as he fulfills the contract with you, it's none of your business aside from giving an accurate rental history reference. Tenant's problems with their "new place" is not your concern, unless by losing this much money he can no longer pay your rent, in which case he gets evicted. --108.250.xxx.xxx |
