State Specific Question About: NEW YORK (NY)
We were advertising and showing an apartment to rent on Nov 1st. A potential tenant wanted the aparment a week before the 1st and paid the security deposit and begged us not to show it anymore as they wanted it. Come the 1st they say they have personal issues and cannot rent and want their money back immediately. How long do we have to reimburse them for the security deposit or can we keep it for the lack of nobody renting it in November as we could have rented but they asked us to hold it for them.

Never take a security deposit, because a security deposit is refundable and they can take you to small claim court, next time take a not refundable deposit if you want to hold the apartment for them.
A lot of times people change their minds and you will get stock with a vacant apartment in the winter.

Did they sign a lease or holding agreement? If you don't have anything signed, you probably have to return the deposit. If you have a signed agreement, go by what that says. --71.194.xxx.xxx |

Give it back. You took a deposit. Deposits are refundable.
Next time, get a NON-REFUDABLE HOLDING FEE. Have them sign a document that a 5th grader can understand spelling out that if they back out at any time, for any reason--any reason--the entire amount is forfeit.
Then when they call you back 30 minutes later and say they've changed their mind could they please have their money back, you say, "No." --108.250.xxx.xxx |

If the applicant gives you money to hold the apt. Off the market and does not sign a lease or take the apt. We would not give them their money back because we took the property off the market to hold that place. You should keep the SD for taking your property off the market.
