on 9/26/12 I sent a Non-renewal notice to a tenant that is under a month to month lease, (30 day notice required by our lease agreement, even if they are a month to month tenant) to vacate on 10/29/12. Rent is due the first day of the month, late on the 6th and summery ejectment for unpaid rent is file on the 17th. Today is the 17th, we filed court papers, she is now claiming that we shouldn't file summary ejectment if we already asked her to vacate and that her statement that we send on the 6th where she was added a 15.00 late fee, didn’t said: "Court papers will be file on your account on the 17th, please pay” However, I remained her that her lease agreement clearly stated rental payment rules and penalties and that she agreed to those terms by signed the lease. I did prorated the rent for this month on her Summary Ejectment for 29 days instead of 31. Is she right? --65.83.xxx.xxx |

No, she is wrong. She still owes rent for the month of Oct. Her lease requires that payment by the 1st, and she still has not paid it as of the 17th. Eviction for non-payment is proper.
