State Specific Question About: NEW JERSEY (NJ)
My tenant has found house and wants to sublet their apartment for remaining time (6 mos) of their lease. Do I have to let them sublease. Also I have a clause for penalty if they break lease prior to end date. Does the subletting offset the break lease clause if they find someone? Can I demand that I must be able to approve the sublettee? --98.109.xxx.xxx |

Should already state in the lease that the sublet leasee be approved by LL prior to move. If it looks good, take them. Try to make them last longer than the 6 months. --67.236.xxx.xx |

Raymond, My goal is FREEDOM!!! which comes from income and time.
I don't know NJ law, but everything's negotiable. ESPECIALLY when there is a chance I might keep or gain FREEDOM!!! Before laying down an ultimatum, I'd ask them what they had in mind.
If they bring you a new resident who passes your screening, it's a win-win. Cash keeps flowing, no re-rent painting/ advertising/ showing/ vacancy costs, and no lost time other than screening.
I'd prefer to start a new year long lease with the new resident to keep things simple and clear.

My lease has a clause about sub-letting. That is one of the few areas where Missouri state laws are in favor of the landlord. With an unapproved sublet, the landlord can charge double rent. --70.246.xxx.xxx |

No law here about subleting but my lease prohibits it. I do allow it if tenants suggest it. As Brad20K says. They find a new suitable tenant to finish the lease that's ok by me. --75.160.xxx.xxx |
