State Specific Question About: NEW YORK (NY)
How many days do I have to return a security depost once the tenant moves out? (N.B. Unit was not cleaned and damage was done. I am in the process of getting estimates and Tenant is requesting return of security deposit.) Thank you very much! --184.153.xx.xx |

Each state is different. I think in my state it is two weeks. --204.10.xx.xxx |

In Texas you get thirty days but CHECK YOUR STATE. Failing to return the deposit within the proper amount of time is very, very, very bad! --66.249.xxx.xxx |

New York is one of the few states that is vague about the deadline regarding this; only specifying "within a reasonable period of time".

Gail (and all responders):
Thank you for your assistance. I did find out from a NYS atty that, as Gail stated, NYS does not specify. Per an atty (my friend's brother), NYS does not address this issue in law; however, it is customarily considered adequate if the security deposit, or portions thereof, are returned w/in 30 days of tenant vacating the property.
Thanks again!
