State Specific Question About: GEORGIA (GA)

i let someone live in my basement since she lost her job. that was 3 years ago. she now has a job,destroyed my basement,has only given me less than 300 a month. the basement is a 3br 1bath with seperate entrance. i have asked her to leave and how much time does she need however, when i did that she told me to screw off. what can i do to get this person off and out of my property? --72.15.xx.xxx

The only wat to get her out is hiring an eviction attorney.

Next time for feel sorry for somebody give them money or pay them a one month rent, but never bring them home, and that's includes family or friends.

In some areas, if your basement apartment was illegal, done without permits and you are not zoned for multi-units (only homes), you may be in big trouble.

In Los Angeles, you would have to refund all rents ever received and pay your tenant like $10,000 to leave.

You need to check with a local real estate attorney. Don't be cheep and get free advice, this is vary serious.

What I would do is tell your tenant that you have to sell the property and no one will buy it with a people living in the basement. Ask her how much she wants to move. Start at $1000. Tell her you will put the money is an escrow account and when she is out and signs a paper to that effect, the money will be released. You may fine that even if you have to pay her $5000, that would be cheep in the long run.

I would call them a "roommate" to avoid what Robert mentioned about zoning.

What they SAY is irrelevant to the legal problem, but it DOES tell you where you stand. By the way, freeloaders and housebeaters ALWAYS bark back like that.

I would start with a written move out deadline. If that does not work offer cash for keys - it's cheaper than paying for court and usually gets their attention. I'm cheaper than Robert, so I start at $300 -

"Mary, on Monday I'm hiring an atty to handle the eviction. His fee is $300. If you will simply be out by Sunday night, no damage, keys on the counter. THEN I give you the money I woudl give the atty.

If you stay and fight this, the eviction will show on your credit report, your employer will see it, and YOU will have to pay my atty. Let's keep this simple and move on."
