State Specific Question About: TEXAS (TX)
I'm in the process of Evicting a Tenant. The Tenant owes the balance of one months rent for September $200 ($600/month) plus late fees totaling $105. If I file for eviction, for non-payment of rent, can I ask for the following judgement 1) balance of rent due for September - $200, 2) late fees - $105, 3) re-letting fee - $510, 4) balance of lease renewal period - owes 4 additional months on 6 months lease October through January)and 5). Jeff, you can ASK, but the Court should not grant you the four months remaining under the lease. You might get one month, if you are lucky.
Be prepared to explain your "re-letting fee" and hope the judge gives it to you.

You would not get all that at my court I go to. You will only get true unpaid rent up to the day of court. You will have to take them to small claims court after the eviction is complete, and you have already relet --173.74.x.xxx |

ELT on your next lease!
Not sure why you're evicting over $200 that is only 13-17 days late. Is there more to the story other than late fees?

Thanks for all the good information. In response to why I'm evicting over $200 (plus late fees.
This is the third time over a 4 month period that the Tenant has been late and the $200 dollars is part of the September rent that was due o the 1st.
From experience, I've seen that once someone gets too far behind on the rent, they rarely catch up. --198.190.xxx.xxx |

The court will shake you down unless you have been there to observe the correct wording/timing in your explanation, you could always accept the entire amount outside the courthouse and if the tenant wants to stay and hear you tell the judge you have been paid all the late/court/damage fees and actual rent and you want to dismiss the case this time.
