State Specific Question About: TEXAS (TX)
Hello,
I apologize if this questions has been answered. (I am having difficulty searching this forum.)
A tenet of our just moved out of a property, with three months left on the lease. He has turned over the property, so we do not have any issues with possession.
Can we hold him liable for the entire three months of lost rents, plus late fees, plus damages to the property? Or do we need to subtract any rents collected if we re-lease the property within the three months?
We simply want to know when and how much we can report to the credit agencies.

You need to actively try to re-rent it as soon as possible. In general, you can charge him for the time it is vacant until you get a new tenant in there -- plus reasonable advertising/marketing to get it rented.
But, yes, if you get someone in there after only a month, then you generally can't "double-dip" and collect from the new tenant PLUS the old tenant. So, yes, you'd need to subtract those rents within the 3 months left on the lease if you get someone in there.

If they do, do not count on getting it,

Here I've never seen the court award more than one or two months no matter how many may be owed. And you aren't allowed to collect rent from two people for the same place. --108.236.xx.xxx |
