State Specific Question About: PENNSYLVANIA (PA)

I got the first month rent, lease is sighned , just need the SD. NOw she backed out. Wants monry back(in cash) told her It had to be a check,wants cash, Said I run a buss. & that's the way it has to be. sigh a release form, she never found the place where we were gonna meet. Wanted me to come to her.Sister driving her got nasty & complained about wasting gas, doesn;t care I wasted 2 hours waiting for her yesterday & 45 min. today waiting at the back Wanted to cash check to make shure it clears.

Started cursing on phone, I lost it, told her if she wants her money back has to meet me.Hed screaming match & i hug up.

Since lease is signed (1 month) can I legally keep the money,she's getting on my nerves.Can't get wellfare help NOW to move in.

Just to clear things up about the lease...is it a month to month lease? Also, did she get keys when she signed the lease? A signed lease is a legal contract, you are entitled to keep the money and she can give you 30 days notice that she is moving. I would not refund the whole amount...why should you be stuck for a month's rent. If you can get it rented before the end of the month, you may consider refunding the pro-rated amount. --98.179.xxx.xxx

Save tenant's phone number under "No Answer" in your phone. At this point, all communication should be done thru writing. You risk bodily harm by meeting up with this foul tempered person and her sister.

I would learn what the law says in your area. You are likely emotionally damaged during this altercation and might make some bad choices that could land you in a heap of trouble.

Btw, for future reference, collect a holding FEE--not a deposit or rent--that is forfeit if tenant fails to pay all money due by the move in day. Spell it all out in writing, then when they back out you can tell them to pound sand. Don't sign the lease or turn over keys until ALL MONEY is received. Then you'll avoid getting stuck with a ... whatever it is you have now with rent paid, lease signed, no deposit, backing out... don't know what you call that. --108.250.xxx.xxx

I actually sounds to me like you received a holding fee or a deposit, but NOT the rent. It would be interesting to actually see the papers that are in your pile.

As others have said, be careful, but be strong, you relied on the rental of the unit, you have damages now that she has backed out.

Again, as others have said, had you had a "holding FEE" that would have provided for the liquidated damages of her backing out, but I still think (not knowing PA laws) that you can attempt to keep what has been paid, get the property back on the market and get it rented.

Rent was for month. Laws here say you cannot keep a deposit/holding fee.I learned that from My Lawyer who teaches the laws to the Dist. Magistrates. They can take you to court & get 3x's the amount. The receit say.s it is rent. --75.75.xxx.xxx

Is there a clause in your lease that says tenant can back out if welfare does not pay her deposit? No? Then congratulations on your new lease. She simply has paid in zero security deposit.

It is time to negotiate a new agreement. My last welfare-should-help prospect proposed rent plus $50 a month. I countered with plus $100 a month and done before Christmas. She smiled and replied "Oh I like the way you think." One payment down, three to go.

A full cash refund of the current month's rent? Only if she paid cash AND the perfect replacement tenant paid cash for the full amount. Take all appropriate cautions for your personal safety. One reasonable possibility is doing the transaction inside your bank. Elsewhere, a cash receipt book can work for money in either direction.

Don't deal with people like that, Anny. You can tell from your early interactions if they are entitled and ridiculous.

You have a signed Lease, so you do not need to return the money unless you have not collected the first rent check.

Practically, I'd probably give it back with a written letter via check only just to be done with them, once HER check has totally cleared the bank and you have cash in hand. Assume you have dodged a bullet. --69.136.xxx.xxx
