State Specific Question About: FLORIDA (FL)

I live in MD & own a rental property in FL. Someone contacted me representing himself as a "property manager" & in error I selected him to manage this property. On the lease where the begin & end dates were to be entered he just wrote July to July, no dates or year. On the line indicating length/time of lease he did not write in 1 year. The tenants are stating the have a open ended lease from July to July & the next July to July.

I want them out, if I evict them would the court "assume" it was a one year lease even though it is not indicated on the lease??

I am learning some HARD lessons. PS the "property manager" has been fired! --71.203.xx.xxx

It sounds like something that would be considered a year to year lease, but that will all depend on the exact wording in your lease and the local laws. Sounds like it is time for an experienced Florida attorney. --71.194.xxx.xxx

You learned one lesson, now get into local housing court and learn what is legal for you to put in your lease or join a local landlord group to gain knowledge of what is accepted practice for the court that controls your area. --76.241.xxx.xxx

You need to find out if the property manager you are using is a realtor or is a real estate agent working for a real estate company. If the person is a licences real estate agent or broker, you can contact his broker and explain that the lease was not filled out correctly.

If the person is not a real estate agent it is against Florida law for that person to manage rentals for someone and get a fee for doing that. You can also put a complaint in with the local board of realtors and also Florida Dept of Business and Professional Regulation.

If the tenant doest not pay rent then you can evict. I would talk to an attorney where your property is located. Make sure the attorney knows Florida Landlord/Tenant law. --98.71.xxx.xxx

Amelia, the 'July to July' is OK by me.

If you really want them out, tell them to leave. You must have some reason such as unpaid rent or damage.

Don't cower in fear that you have to let them stay.

Tell them to leave. Maybe work a deal. Or Cash for Keys. Everything is negotiable. They might be looking for an excuse to leave. There are MANY ways to get people out without the courts.

If not, evict.

Locate some local LLs or a local association and ask about the local judge's style. --50.129.xxx.xxx
