State Specific Question About: FLORIDA (FL)

The unit above my rental has leaked into our bath on and off about 3 years, each time requiring repairs in our unit. This time, we tried to make sure the leak was really taken care of permanently. However, the tenant is complaining it's taking too long and that I'm not 'pushing' the owner upstairs to finish the repair fast enough and that she can't continue to live without a full bathroom. She doesn't want rent deductions; she wants me to give other owner an ultimatum and charge him if we have to hire someone faster to do the repairs. The leak cause has been fixed, but the owner upstairs waited a week to make sure no more water was coming down over that time. I agreed. Why open the ceiling again if more leaking occurs? Then he took time getting contractor estimates. Then he took time scheduling the plastering, over two visits to dry it out. Next will be painting, when the owner is not either working or in school and the tenant also allows someone over...it's crazy. What is the correct treatment for all this? Who has precedence? Who owes who what? Am I supposed to pay for workers if it takes too long? What if owner won't pay me back? Thanks. --72.46.xxx.x

I am guessing that you mean that you own a condominium.

Subject to your CC&Rs, the owner upstairs is probably liable for repairs, but there also is probably no method of enforcement of this responsibility in the governing documents.

You probably have no rights at all about making sure that the upstairs owner's plumbing is repaired correctly.

What you probably DO have rights about is the repairs to your unit. If you are not satisfied with the upstairs owner's response, go and have the repairs made yourself, and sue him in small claims court for reimbursement. Your authority would be the CC&Rs requiring upstairs owner to be responsible for damage from his unit, plus your attempts to resolve the matter and his inefficient response.

Another reason not to buy condominium for rentals.

I don't want to buy anything with multi units and I only own few of them. Too much trouble. If I buy, I would buy all units, not just part of the whole building. --198.51.xxx.xxx

It seem like that the upstairs unit owner did not report it to his insurance company. If he had turned it over to his insurance company it would not take this long.

Check to see if he had turned this over to the insurance company.

Response to rent101's statement that if it had been turned over to the insurance company, it would be taken care of.

I had the opposite experience after going with Kemper's preferred contractor to repair the damage from a leaking swamp cooler line. Six months later, repairs were still not finished. We settled with Kemper to finish up the repairs ourselves.

Because the unit was empty at the time of the damage, Kemper initially did not want to pay lost rent, but did end up agreeing the repair time was excessive. The reimbursed us 3 months rent/utilities. --64.92.xxx.xxx

Additional info - as a result of the water damage claim our insurance on a different unit increased from $618. a year to over $2,000. That is the first unit we've had come due for insurance since the damage . . . the agent said that we did show the claim against our name and the rates went UP. Big time. We ended up shopping around, got a lower rate with far less coverage than before.

2 things come to mind:

1st-- owner upstairs could be held liabel for damages and any lost rent due to lack of response in a reasonable time. A week or two is understandable-- but several years????

Send a certified letter.

Class I went to suggested never turning in inurance calims for less than 10K-- reason -- rates go up-- from 600 to 2K it does not take too many yrs to pay for the 8K of repair.

It's not TOO much trouble to own condo rentals. Just maintenance for a future investment! Key is to renovate from as soon as you can. Then you have less problems. Also, all properties require some work. That's why you get the rental profits and sale profits when you sell if you do! Remember, if it's not paid for, tenants are also PAYING the mortgage! To Rent 101: Neither of us probably have renter's insurance. That is why he is taking long...to spread out the expenses. But my tenant doesn't appreciate that! I also don't see how my getting the insurance would help. Even if my insurance paid, they may not have succeeded in COLLECTING the refund back from the other owner if HE HAS NO insurance! --72.46.xxx.x
