State Specific Question About: WASHINGTON (WA)

Hi,

My previous tenants have moved out and we are planning on reaching a settlement on how much they will pay to repair the damages they caused or they helped caused.

I would like to know if there's an agreement not to sue each other after the settlement.

Actually, their deposit wasn't enough to repair everything. I am asking for more. But I won't ask for the full amount, in order to reach the settlement without having to take them to the court. I would like to close the book on this ASAP and make sure nothing will arise from this in the future.

Are they employed in a manner that is garnishable,if yes take them to court and get the full amount and go after there paycheck and learn from this and tighten up when you start an eviction next time. --72.224.xx.x

Why discount, you are giving away your time, tools and talents - how does that work when you go to the grocery - filling station or get parts for your boat motor? I didn't think so, stick to the damages and stick to the story in court - these damages were not caused because there was a windy sunday morning and the closet door closed from the wind thru the window. --76.241.xxx.xxx

Me? I have them sign a Promissory Note stating "they agree to the full amount. If they pay within XX days, I will discount the amount.

If not paid by that date, we will file in court for the full amount plus filing fee, attorney at $240 per hour."

Charge full full price, the same as if you hired a contractor and went to court. Then negotiate from this higher amount.

BUT...

you sound too quick to give in. What it is is what it is.

Never START a negotiation by discounting. Mine sign on the spot for the full amount I say.

MY negotiation is "I COULD file today but I'll give you 30 days to pay as my "give" in this negotiation. If you cooperate and pay, it will stay off your public record and credit report." --50.129.xxx.xxx
