State Specific Question About: MARYLAND (MD)

The abandoned property adjoining my rental property in Baltimore is going through foreclosure through the Bank of America. It is in terrible shape and is the source of rodent and isect infestation. I share a common wall that has, on occassion, been penetrated by rodents and insects. The city has issued many housing citations but has no access to the inside of the property. Bank of America has been responsive but the problem persists. It may result in my property becoming uninhbitable. Any suggestions for how to approch/resolve this dilema? --69.255.xxx.xxx

@Reid: How can he sue BoA? BoA is not the owner, and as Lender is not responsible for anything.

@GDS: When BoA owns the property (you said that it is GOING THROUGH foreclosure, which means BoA does not yet own it), send them a letter, certified mail, return receipt requested, informing them that their property is a nuisance and is causing you tremendous problems, that you will sue unless all defects are cured within 14 days, and that in the alternative, you will be happy to buy the property from them for $____ cash in its present condition, and cleaning it up yourself.

GDS - good post!

I'd say this falls under "do you want to be right or rich?"

Right will sit around whining about how someone else is not doing their job. Rich says "get 'er done so MY income keeps flowing."

I would make my own access to the interior and do my own cleanup in self defense. No one will know or care.

BOA is not going to come down and say STOP MOWING! PUT THAT TRASH BACK! STOP LAYING RAT POISON!

Locks keep honest people out.

A pane of glass is only 1/8" thick and disappears with one tap of a hammer. They would probably appreciate you placing plywood over it. The neighbors will not call the police "Officer, I want to report a man cleaning up the neighborhood! Send a squad car NOW!"

If your side is properly sealed, the rodents won't have a way in. I know they are tough to stop, but YOU are tougher and more motivated. --50.129.xxx.xxx

you'd have to do some checking and I'm not sure how or where that is but if BOA has already taken possession of the house, even though they don't technically own it yet, I'm betting you can sue them for damages to your property. when homes are going through foreclosure and have been abandoned, the bank takes possession - they change the locks, make sure the property is secure, winterize, do VERY basic maintenance (enough to be certain the property doesn't deteriorate and enough to keep the municipality off their back).

find out who the asset manager is - they probably have a note on the front door - and jump all over them.

I also have "noticed" "open" doors on abandoned properties more than once.
