First thing you need to do is read your state's land lord / tenant laws. This question is a fundamental that any landlord should know forwards and backwards. I'm worried that you don't know what you're doing based on this and are going to end up getting your butt sued off.

Second thing: you don't just "keep" money for anything. What you do it correct the condition of the damages--per your lease/rental agreement--then bill the cost to the tenant. If they have moved out, you bill it against their security deposit and send them a summary within the time allotted by your state's law. Fail to do this correctly and/or in the time frame RI law, and you could be liable for up to triple damages (in some states) for the amount wrongly withheld. See why I'm concerned for you?

Time to sharpen up your business knowledge.

P.S. If the unit was dirty when they moved in, you cannot charge unless it is now dirtier...let's hope it was clean...I'd hate to have to prove "degree of dirtiness" in front of a judge. --208.70.xxx.x

Do you have any proof that the unit was clean when they moved in? I have an inventory that everyone signs at move-in stating the condition of everything in the house, from freshly cleaned carpets to washed windows to freshly painted walls. Before move-out I warn the tenants that they will be charged if they don't leave the unit in the same condition. (I even give prices for dirty appliances, dirty bathrooms, etc., so they know I'm serious.) At move-out, I hire professionals to clean and repair the unit and then deduct the cost of that from the security deposit and return the balance with proper accounting.

Compare the move-in photo set to the move-out, damages and dirt are not wear-n-tear, if you have sally's oven and window cleaning come over charge the receipt against the deposit, be sure toilets flush and fridge does not have food stains which will quickly turn to stinky odors. --76.241.xxx.xxx

Do you have proof that that was clean when they moved in,

You may charge the prevailing wage to clean it up after they move out, if their is any difference them you owe it to them, not yourself.

The SD is not yours to keep, it is to pay for returning the property as it was when rented, not supplement some crooked LL's income.
