State Specific Question About: NEW JERSEY (NJ) A tenanr left a deposit for an apartment in April to move in by the 15th of April. She never showed up again. called several times and never found her. In the meantime I kept the apartment for her not knowing what has happen.
Just got a call from her June 1st saying she will not take the apartment and want her money back after I held the apartment for her for 2 months.
How should I handle this?

Here's the important question-Did you call it a deposit or a holding fee? A deposit will probably have to be returned. If you had her sign a nonrefundable holding fee, that would be a different story.
I don't understand why you held the apt. so long when you couldn't make any contact with her. Did she sign a lease? If so, you will be on stronger ground. If you simply took her money and never had her sign a lease or holding fee, you will probably have to return the money. --76.222.xx.xxx |

You should have been showing when her holding fee expired, if it was equal to one month rent you are aprox 30 days slow in trying to get a qualified tenant, what did your holding agreement say about refunding? --68.76.xxx.xxx |

Should have been for a holding fee but if it said for rent my position would be she used up that month and now owes for the second month,that might help put it in perspective for her and she will leave you alone but in the future holding fee with a date that it is forefeited --67.252.xx.xxx |

I agree with the phasing of the receipt. Deposits should be returned, holding fee not. Should have gotten her to sign some sort of agreement that it would only hold the place for a specific length of time or forfeit the fee. I had someone look at a place at the end of February for an April 1st move in date. Said she was very interested, put in an application, I reviewed it and offered her the place. Said she would get back to me pay day to put down the holding fee and sign agreement. Pay day came and went and no check or signed agreement, I moved on with the next candidate. If they want the place, they will put down the fee. I never heard from her again so she was not all that interested. Just as we are always looking for the fight tenant, they are always looking for the right apartment. And, I wouldn't hold a place for very long.
