State Specific Question About: FLORIDA (FL)
I have a female and a male tenant living in my home and can't get along. Male tenant is willing to keep the pease but the female tenant does not. She sleeps all day and doesn't work. She gets drunk almost every night and disturbs the male tenant with volger language and beating on his door and using racial slurs. Listens to music very loud after local cufew and disturbs the neighbors also. I have tried to be nice and let her know what the laws are in Florida and she thinks I am being a angry,mean Landlord. They cannot get along because she doesn't want to, so I have a Month to Month Agreement and I kindly ask her to find another place within 30 days. Now I believe from what I read I am only required to give her 15 days. So she says she is not moving and I can't do anything about it. If I give her a notice signed and hand delivered to vacate within 15 days will the Sheriff come and escort her out? --97.97.xxx.xxx |

What does your lease says for notice that they have to give you for them to move? Are both names on the lease?
You will have to give them (both) 30 days writen notice if you lease says they have to give you 30 days. You can not give verble notice, it has to be a writen notice. Give them the notice saying they have to be out by June 30.
If they do not move out you will have to file an eviction.

Tell her she is gone, termination of lease/ rental agreement due to X (assume you have a somewhat decent lease with some clause). In writing and in verbally. Follow your local and state laws. IL requires 30 day if mo to mo, read the link above on your state laws.
Ask her point blank when you will be getting the keys back. I hang a carrott over their head of i may give you a decent referal and some of your deposit back IF you get me the keys by X.
Start eviction proceeding immediately regardless of the conversation. Get a flat-fee lawyer if your first eviction. Or head to the courthouse and check out the local process. --24.245.xx.xx |
