State Specific Question About: VIRGINIA (VA)

Is it legal to put a noise clause in a lease limiting the volume of noise potential tenants can make as well as the time frame they can have parties (which would abide by the local noise ordinances)so that they do not create a regular disturbance through regular weekend kegger parties? --108.28.xx.xx

Here is the one I use in our lease agreements.

QUIET ENJOYMENT: The Landlord covenants that on paying the Rent and performing the covenants contained in this Lease, the Tenant will peacefully and quietly have, hold, and enjoy the Premises for the agreed term. If there are any complaints about the Tenants noise level and/or any drug use we have the right to terminate this contract immediately or at the Landlords discretion. --108.178.xxx.xxx

NOTICE OF NOISE COMPLAINTS

To Mr. WWW / Ms. ZZZ:

BBBXXX Rental Properties have received numerous complaints about the high noise level coming from this housing unit. With the police being called to handle the high noise level and drinking parties late into the night.

Per the lease agreement on Quiet Enjoyment, all Tenants are required to keep the noise level down after dark. These problems will be cause for termination of your lease agreement with BBBXXX Rental Properties.

There are other people who are having problems sleeping due to the high noise level coming from this unit. Please keep the noise level down after 10:00 pm. There are people in the neighborhood who go to work early and children to school.

The problems at this residence must stop immediately or the lease agreement will be terminated. If there are any more trouble from this residence your right to occupancy will be terminated.

Thank you for understanding and we hope there will be no more problems at this residence. All Tenants are to have Quite Enjoyment per their lease agreement.

This is a month-to-month rental property. If you see this situation is not going to improve then it would be best to return the keys to our office at the end of the month. BBBXXX Rental Properties is open from 3:00 - 6:00 pm, last day of each month for key returns.
