3 weeks ago tenant was found dead in apt. County took body and indicated he died of natural causes. No relatives can be found. Apt. is full of his stuff. What is the next legal step to take to gain posession of apartment and what to do with his stuff? 7 day notice will not work in this case! --98.209.xx.xxx |

Move items into storage, and let the storage facilities deal with the non payment after 60 days.
Limit your liabilities, and move on.

Do you have any emergency contacts? What do they say?
You said no relatives could be found.
Did tenant pay May rent? If not, I would probably do a foreclosure, keeping my mouth shut about the death.
That's just what I would do.
Others might just take possession, keep whatever they wanted, throw out the rest, and play innocent if and when someone comes out of the woodwork.

I use this answer all the time...and sometimes I wonder why I repeat it so often...then I read some of the responses and think "THIS is why is bears repeating." Sorry if that offended anyone, but really, are ya'll thinking straight?
This kind of thing HAS happened before, which means there is likely a LEGAL process that needs to be followed. Which means you need the (here it comes) the advice of a local, experienced, attorney. In this case, I amend my advice to not specify "land lord / tenant" attorney because there has been a death involved. Perhaps you need an estate attorney. Whatever...get legal advice and bill it against his security deposit / estate. In this case, if he has anything worthwhile, you should hopefully get compensated when it gets sold at auction.

Note that most of the above are NOT familiar with Michigan law. The EASIEST way to do this if they have NOT paid May rent (you said 3 weeks, so hard to tell if they paid for May or not) would be to consider it abandoned. Michigan law is pretty poorly written on MOST things, but the abandonment clause is pretty straightforward: post a note on the door stating that the rent is unpaid and you are considering the apartment abandoned and to contact you within 48 hours if that is incorrect. When you get no response, you can legally IMMEDIATELY retake possession.
At THAT point, you're back to Michigan's poorly written laws: you need to store that stuff (if it has any "value" -- which is also not defined) -- for an indeterminate amount of time -- to see if anyone comes to claim it. heh.
Let us know if he had paid for May or not -- that will actually tell us a lot about the next step.

Posting on here is a good first step but only a beginning. If it were me, I would:
Review your state laws on abandonment and eviction. I would also do a quick internet scan for possible information. If you do not find something hard and fast- such as specific language pertaining to your situation in the state law, then I would contact an attorney. I would also do as much legwork as possible to find a point of contact regarding this tenant's family or friends. You may have to go through probate.
I would not touch the stuff until I was 100% sure about could legally be done. I would go see if there are any hazards in the house and take care of those and I would clear out perishible food and animals.
