State Specific Question About: OREGON (OR)

The lease makes the tenants responsible for the lawn but they aren't mowing it. The city will cite me if it isn't mowed down soon. What legal grounds do I have for having it mowed and charging the tenant for the work? --75.244.x.xx

If the lease requires the tenants to maintain the lawn, I would be reasonably comfortable in having a service come in and do it and bill the tenats for it. AFTER sending Tenants a copy of the citation warning and giving them a deadline to clean it up.

My lease allows me to give them notice to take care of the yard and if they do not, then I can do and charge them...

10. GROUNDS & PATIOS: Grass cutting and plant trimming and weeding will be responsibility of the TENANT. Should the grounds or exterior maintenance not be cared for, then the AGENT shall give TENANT written notice to have work completed or AGENT shall have the work done at TENANT’S expense. --184.5.xxx.xxx

Hi Tim...

As noted your rental agreement should have defined who does the grounds and to what degree.. you've apprently done that..

Your next step is a demand, 3 day notice for cause

You are covered under ORS 90. 262 and

90.325 Tenant duties.

(1) The tenant shall:

(a) Use the parts of the premises including the living room, bedroom, kitchen, bathroom and dining room in a reasonable manner considering the purposes for which they were designed and intended.

(b) Keep all areas of the premises under control of the tenant in every part as clean, sanitary and free from all accumulations of debris, filth, rubbish, garbage, rodents and vermin, as the condition of the premises permits and to the extent that the tenant is responsible for causing the problem. The tenant shall cooperate to a reasonable extent in assisting the landlord in any reasonable effort to remedy the problem.

(c) Dispose from the dwelling unit all ashes, garbage, rubbish and other waste in a clean, safe and legal manner.

This has been interpreted in case law to inclued grounds if the rental agreement assigns the care to the tenant..

TO AllyM - is this for Single Family homes, too? How many do you have? It would seem very hard to manage this with more than about 3 or 4.

If it is a complex, sure - I would be in charge with a lawn crew.

This is why I service lawns. No nonsense. Do it yourself or hire it out.

Include it in the rent and let the tenants know HOW EASY THEIR LIFE IS GOING TO BE, while they are living at your property.

Makes them feel a little spoiled, even on single family homes.

Plus, they get to see my smiling face or someone I hire every once in a while to remind them who is in charge. --216.37.xxx.xxx

I usually have thenant take care of lawns. mowing only. Buy a cheap lawnmower-- write your name on it and leave it with them to use.

they most likey do not have lawnmower.

In the lease I stated that the tenants would be responsible for utilities and services. I told them this would be for grass cutting when needed and snow removal when needed. now they are refusing to pay the grass cutting bill. It is only $35 a week which is a bargain --69.248.xxx.x

I still take care of my rental properties' grass and shrubs. It's built into the lease prices. I always allow 2-3 weeks between cutting. Im 30 now; when I'm 40 i will probably hire it out for someone willing to do a volume discount. --172.56.x.xxx
