I'm learning my lessons the HARD way -

If I've already rented the property out, am I entitled to collect and/or verify personal information about my now-tenants? If so, what information? Which statute is it?

If they don't fill it out, it's their choice. You can't evict them for that. You are only entitled to verify information they are willing to give you. As you noticed, you surrendered most of your trump cards by letting them in without this info. I know you'll never do it again. --208.70.xxx.x

I know many people on this Forum disagree with this (it might vary from state to state), but I was always taught that even if you have an application from a prospective tenant, and the application gives you permission to run a credit check, you can only run the credit check BEFORE the lease is signed. That is because (at least, this is what I was taught) the permission to run credit is only valid to assist you in making the decision of whether to extend credit. Once that decision has been made (i.e., you have already rented the property to them or you have rejected them), you no longer have a legitimate interest in running their credit.

That is with their permission. Without their permission, you are limited to public records searches -- which can still be useful!

I agree with Mike - I don't think you can demand an application be filled out after you've already signed a lease agreement with them. Sounds like you're stuck with them now. Since this doesn't fall under any of the anti-eviction clauses of NJ, I don't know that there is really any caselaw on it either... --216.139.xxx.xxx

I disagree with Mike45 (a rare event). I believe that once given permission, you can run the credit for any legitimate business reason, though I certainly would not abuse this privilege. Do you have a signed Lease with them (this is in my Lease as well)?

I've never done it. Why don't you have this information? Did you inherit a tenant with a new purchase? Go to the Seller.

I'd send them a form first, stating that records must be updated for current and new tenants and must be provided by X date. --69.136.xxx.xxx

Maybe if they are late on their rent and you need to decide if you want to serve a __ Day Notice To Pay Rent Or Quit immediately or give the tenants more time, you can argue that that is a legitimate business reason. But the OP did not posit that situation. If the Ts are paying timely, I don't think you can do it.
