State Specific Question About: FLORIDA (FL)

I have been learning as much as possible about FL law, as but still have a couple of questions.

1. What is the max late charge I should put in lease.

2. When rent has not be paid, I just post a 3 day on door, then what? Can anyone post it?

3. vacant notice here is 15 days notice, but I can put 30 days in my lease right?

4. From start to finish without issue, how long does it take to get a non payer out.

5. Do I need to be in FL to evict, at what point to I need to be present.

Answer to your questions.

1. There is no law about how much a late fee will be, but if it went to court the judge might say it is to high. I have a late fee of $100.00 for a rent of $1,000.00.

2. On the 3 day notice check Florida Statutes 83.56 for the ezact wording on your 3 day notice. On the bottom of my 3 day notice I put the date and time it is taped to the front door.

3. If your are renting for a year you can put 30 days writen by either part of moving out or to move out ( If your are giving notice to move out or increase rent you must give an extra 15 days notice of what your lease says).

4. I would us an attorney who knows the landlord/tenant laws. My attorney can get them out within 3 weeks.

Since you are not in Florida, it might be best to have a Real Estate Company who does property management handle your property. They are very knowable of the local and state laws.
