State Specific Question About: MARYLAND (MD)

One of my friends is a LL, and she asks her tenants if they are willing to have their rent taken out of their pay automatically using direct deposit. So, basically, when they get paid every 2 weeks, half of their rent is automatically deposited into her bank account.

This is how she chooses to collect her rent. If they don't agree ahead of time, she doesn't select them to be their tenant.

I'd like to know if there is anything illegal about this in Maryland. And what if the tenant agrees? I about about to rent out my first property and as long as someone holds down a stable job, this sounds like the most secure way to collect rent. --108.40.xx.x

It wouldn't be an agreement of the tenant's employer. It would be the tenant. So, for example, when the tenant signs up for direct deposit on their job, they would designate one of the deposits to go to the landlord's account each pay period. --108.40.xx.x

My day-job doesn't allow me to have more than one deposit, so this would knock me off your friend's list of possible tenants. A better way is to use the service on this site to take the rent from their bank account. That way, you only take the amount of the rent, and don't overlook people like me.

BTW, I'm a teacher and I'm paid a salary monthly. Most of the time, teachers make decent tenants.

I have low end rentals where they go to the bank physically to deposit into my bank account

Some of the older tenants cannot get used to the idea of driving to the bank to deposit rent

I have asked older tenants if they can do autodraft or go to the bank and they are against this method of rent collection

Some of the older tenants on ssi income are terrified of auto draft or going to the bank to deposit rent, its a change that they cannot handle

I wish all my tenants could direct deposit to bank or pay ck autodraft but it seems that the younger tenants dont mind this but the older tenants are totally against it

People are funny about payroll direct deposit to another person's account and some are ok with going to the bank in person where they get a deposit slip for receipt of rent payment --76.123.xxx.x

I use Clear Now and LOVE it. Unfortunately, though, we purchased the next rental house out of our IRA and so we can't use Clear Now. When the resident signs their lease they also sign up for Clear Now. On the first of every month, the rent comes in. Also about 10 days before that the resident gets a notice that the amount will be taken from their checking account. No late payments ever! --174.70.xxx.xx

I was thinking that direct deposit straight from the paycheck was safer because it would never hit their bank account first, which would never give them the opportunity to be irresponsible.

I might have to try clear now.

I'm scared because I have good credit and I'm scare of gaps in payments. This will be my first time being a LL.

Can I make using Clear Now (or something similar) a requirement of signing the lease? Is that illegal? (I live in Maryland). --108.40.xx.x

Silk,,, you can pick your friends and you can pick your nose but you can't pick your friend's nose.

I have never heard of such collecting straight from the employer pre-deposit... unless they work for you or something, then you'd want to talk to your tax man...

if you are "scared" then these are your fears and figure out how to deal with them. Read more books, there is to much at stake in RE investing to be "scared" going in.

You can not be guaranteed security while you have fears. Matter of fact there is no guarantee about anything. Join a Landording group in Maryland and find out how others in your area collect rent and if they think their method's reduce risk. --184.239.xxx.xxx

Jobs come and go so I just give two simple options. Auto deduction from their checking account (bank check comes to you by mail - never late) or on-line (or walk-in) deposit to a "rent capture account" used only for that purpose. Then I can go on-line and transfer to my accounts as I choose. All times and dates are on-line for verification. It's just too easy compared to all other traditional ways of collecting rent. --50.131.xxx.xx
