State Specific Question About: TEXAS (TX)
Husband and wife on lease, husband moves out, wants off the lease.Originaly they signed a years lease they fulfilled the lease and terms. They are now on a month to month lease.Wife still wants to stay in the house. What should I do? Can he be taken off the lease, what needs to be done to protect all of us? Is there a contract? --98.199.xxx.xx |

Yes, there is a contract (the lease).
Letting the husband off the lease means that he is no longer responsible for whatever obligations there are to the lease. No advantage in that to you.

I would explain to whoever is staying, assuming they are qualified that I will create a new 1 year lease at the new higher rent and this way the other party won't be on the lease. This way you either get more rent or cooperation from the party who is staying --67.252.xx.xxx |

Does the wife's income support the rent? If not, she is a bad risk. --168.7.xxx.xx |
