State Specific Question About: OHIO (OH)
Looking for clarification and verification. We are in process of evicting a tenant (3 day notice & filed, court date set). Eviction is for failure to pay rent. AS further background, he is my son (don't need lecture on that point other 2 kids who rent pay their rent!) and my wife suspects that he is conspiring with my ex to try and bet the eviction, by paying the back rent into escrow & thus preventing eviction for non-payment. I maintain that he cannot do this as he must be caught up with us before starting an escrow account with the court. Who is correct or is the truth in between? --50.41.xxx.x |

AFAIK, any rent must be escrowed BEFORE it is due, and it usually is b/c of unliveable conditions.
If he escrows all the rent money to get caught up, I think the most the judge will ask you is if you want him to stay or if you want to proceed with the eviction.

Every court is a little different but I would proceed with the eviction. If the tenant does put rent into escrow they have to prove to the court they have notified you of maintenance issues and you haven't dealt with them. The eviction court will determine if the tenant is stalling or not. If they think they are stalling the court will probably ask you if you want them out or would be willing to accept the rent (released from escrow) after you have made the repairs. Once you accept rent expect the eviction to be dismissed. --74.83.xxx.xxx |

Some courts have the info online about escrow, it is used for the tenant to pay when a sewer is not taking water, landlord uses it to deposit a partial payment as this cancels the eviction in most OH courts, you need to visit housing court - where are you in OH? --99.128.xx.xx |

Marion, Court is in three days, & don't have time to visit court to ask & clerk won't answer any questions anyways. He is making noise about having the money, & will only pay it if we cancel the eviction, which we are considering, if only to immediately reserve the three day notice (we would collect more money this way and only delay the eviction by a month at most) We do not have a separate housing court here. --50.41.xxx.x |
