State Specific Question About: NEW YORK (NY)

How do I evict a tenant from an illegal basement apartment? I let a friend of a friend stay in my basement because she was having problems with her boyfriend. She did pay me money but now has stopped and is refusing to leave. What can I do to get her out? --108.14.xxx.xx

I had the same situation. I took her to court for nonpayment and she brought up the fact that the ceiling was too low. The judge told her to leave and social services assisted her somehow. That was one of my four units and they were inspected by the state. I had a friend's brother in there for free and they made him move due to the ceiling being a few inches too low. He was a disabled veteran. He is now in a group home sponsored by a veterans group. --69.141.xxx.xxx

Many landlords make basements into illegal apartments. Your City, like most others, won't allow you to collect rent from an illegal unit. Also they won't allow you to evict someone for not paying rent in an illegal unit. So how do you get rid of them? Each case is differnt. Money for Keyes. Give them a free car? If they leave you'll pay their move in cost on their next apartment? Do you get my drift? You are so screwed, you have to play nice and give to get them out. --173.58.xxx.xxx

I have a rooming house and when I have to get rid of someone we put pressure on them and most can't take it and just leave.I would start being there and pestering them to leave several times a day,get a truck and tell them to load it and you will deliver it wherever they want,you will be surprised how fast people will go --67.252.xx.xxx

If there is a fire in a illegal basement apartment no matter how the fire is caused one can face a huge fine from city along with the insurance will not cover a illegal rental unit. The insurance company that insures the apartment buildings will not even write up a policy for illegal apartments in houses. Evicting the tenant may be a problem as well. Here the building and fire code inspectors are not enforcing the building and fire codes. When there is a loss life in these illegal rental units then the fire code inspectors go after the legal apartment owners where they require buildings built fourty years ago to be brought up to the present fire code. For the people who run legal rental buildings it is very unlevel playing field where those illegal apartments in houses are paying property tax on a single family home along not having the expense of having a central fire which requires inspections every year. So when one gambles it is great when one is winning but very bad when one gets into serious trouble. --74.220.xxx.xxx

dead fish or he called it a "chicken

The shrimp in electrical boxes will have you hunting that smell for months if you did not read about somewhere like here, a awful odor that starts about a month after moveout, now I pull all the covers and vacuum before doing the gelbait, takes an extra couple hours for years of no-bug calls. --76.241.xxx.xx
