This is for a friend who is a landlord, so I'll try to get all of the story straight. The renter changed the locks, which was against the rental agreement. So, the landlord changed the locks back to his key. He left a note on the door that the renter needed to call him to retrieve her stuff. My question is, "How long does he need to store her stuff before he can dispose of it?" She appears to have moved most of her things out already and has not paid the rent in three months. He is an attorney, so he did give her notice to move out.

The law about how long you need to keep a tenants stuff in Wisconsin just changed as of March 31, 2012 so be sure to look directly at the Wisconsin landlord tenant sites and not at the national sites with old info.

The summary is:

Disposition of Personal Property Left Behind by Tenants. In the absence of a written agreement to the contrary, most personal property left behind by a tenant is generally presumed to be abandoned and may be disposed of by a landlord in its own discretion provided that the landlord has provided written notice to the tenant that it does not intend to store any personal property left behind by the tenant. Note, there are some limited exceptions made to this general presumption for particular types of personal property and special types of leased facilities, such as self-storage units and situations involving a known claim by third party lien holders. This general presumption applies to both residential and commercial properties. --63.81.x.xx

Your friend the attorney better wise up and call a local, experienced, LANDLORD/TENANT attorney who knows what he's doing...I think your friend is skirting the edges of what's legal, if not completely stepping overboard.

Once possession is granted, it can only be recovered after the tenant vacates the premises--usually signified by removal of all belongings and turning over the keys--or by the legal process of eviction. Changing locks because they don't pay rent is a no-no where I come from. --208.70.xxx.x

I agree with Sid but from a practical standpoint why try to stop someone who is leaving and owes 3 months rent.Sounds like a control issue but I would have just encouraged them to get everything gone then changed the lock --67.252.xx.xxx

Sid, the landlord didn't change the locks because she didn't pay rent. He changed the locks because SHE had changed the locks (without landlord's knowledge or approval, even though the lease specifically prohibited that) and he changed them BACK to his master key. --75.121.xxx.xx

Yep, I read the part about changing locks because tenant changed locks. Does matter. If land lord has illegally denied tenant access to the unit (i.e. tenant doesn't have the 'old' key), he could be in hot water.

How can he prove that the locks were changed back to the same key as what used to be there so that the tenant now has access? Did he leave a copy of the key at the unit? What's the judge going to say? Good luck.... --108.225.xxx.xxx

Take the wrong locks to court, this is another reason I engrave my locks with dumb code letter/number - took the photo and the lock one time to justify after heated pre-trial carried into hallway, tenant lost case afterall. --76.241.xxx.xxx

Wow, this site is AMAZING. I learn so much from all of you. I assume my friend knows what he's doing -- he's an attorney. But, I guess you can never be sure. I know that he wrote a note to call him, but not sure how else this has proceeded. I don't know if she's contacted him or not.
