State Specific Question About: COLORADO (CO)

Can someone tell me how long it usually takes to evict a tenant for nonpayment. Also, we have a lease until 06/30 but our tenant is intending to leave at teh end of May (and not pay May's rent). So are we better off evicting them even though we are not going to get may's rent paid or hope that they leave and go after them for May's and June's rent that they would owe? Someone will come along with more information, but I assume you can't evict for non payment until they miss the due date. So if that due date is May 1st and they are paid up until then, currently they are not behind. So you could still get May's rent, just because they are saying you are not, that is not a fact yet. --174.159.xxx.xx

My last unlawful detainer was set out 3 weeks in jeffco, however the tenant left. Expect another week at least for a sheriff to meet you if it is a forced removal. In reality your local housing court timing will be the best example, how often do you visit to brush up on the inner workings? you could look there for a flat-fee eviction service and get a few quick answers between cases, every one of us landlords hopes for less than a month from filing to lock changeover but it only takes one mistake and you have to start from the beginning so be sure all your paperwork is in order and if you are not sure what to do use the eviction service who is used to your court system to do the job. --76.241.xxx.xxx

As others pointed out. It depends on what county the property is in. You are not likely to get them out sooner than a month and it will likely cost you about a month's rent to get them out if it goes all the way. At any rate, if you really think they may not move at the end of May then cash for keys or move on the eviction pronto.

You can also do some of the eviction process yourself and may actually scare them into paying or leaving. Post the three day notice as soon as they are late for starters.

Find an attorney specializing in evictions and you can probably get them to pay or move early for less than $500.

As you are doing, get out in front of this and get the attorney in place now as they get busy around the 1st of the month. --75.160.xxx.xxx

If you serve the three day notice as soon as they are late. Then file the eviction, the court date is usually 2-3 weeks and then another 5-7 days to serve the eviction. A lawyer and the fee is $250. So you lose the rent and another $250 for the lawyer. I agree with others. Try to work out something and get them out. Offer them $400 to leave immediately. Even though is sees like they win, remember, you negotiated the terms of their departure and they certainly won't get a good referral. Thanks everyone - We were planning on pursuing them for the rent they are liable for through the end of their lease (which they are breaking) which would be two months plus any damamges in excess of the deposit (which we expect to be extensive).
