State Specific Question About: OHIO (OH)

A lady I was renting to allowed her grandmother and her uncle to move in with her just prior to her moving out. She has vacated the premises, but the grandmother and uncle haven't left. They assumed I would let them stay there!!! Besides filing for eviction(which I have done) does anyone have any suggestions on what else can I do (legally) to get them to leave? The utilities are in my name, but I don't think I would be allowed to turn them off with someone still in the apartment. Thanks for any suggestions you can give me.

Taking the utilities taken out of your name is perfectly legal. Putting your own lock on their water meter is not. The water dept. will cut the water off,..not you.

I would not shut off utilities if you have been providing them. This would be a self help eviction. Has the rent been paid? Did you name your now gone tenant in the unlawful detainer? Why do you not want to rent to them? Make them fill out an application and pull background. --192.94.xx.xx

You need professional advice from a local, experienced, land lord tenant attorney to avoid doing something illegal and potentially exposing yourself to a law suit.

That said...

How long have they been living there with your knowledge? If it's been more than a couple of weeks, one could argue (correctly) that you accepted them "by default" since you didn't demand that they be added to the lease. In that case, they would be "hold over" tenants and would have to be removed just like any other tenant.

If your other tenants moved out yesterday--and you have no knowledge of them until today--I think you could have them arrested as trespassers and/or could toss their crap on the curb and change the locks.

Much will depend on how much you 'tolerated' this lease violation and for how long. Did you--when finding out they lived there--issue and immediate 'cure or quit' notice? Or did you just let it go, knowing they'd be moving out "sometime?"

Has the previous tenant turned over keys/possession? I'd say "NO" unless you signed something. So time to contact this lady and inform her that unless she gets them out in 24 hours, she will be named on the eviction law suit. Have a nice day. :-) --208.70.xxx.x

I see 2 ways to solve this, one is have them removed as trespassers - they may produce mail which shows they are a resident, ask them to pay rent and in the eyes of the zone car officers it will be a civil matter requiring the eviction, method 2 is write a lease to another tenant as long as the lease has expired on this property, you have come to change the locks and make simple preparations for the new tenant next week - bring the new lease with you and the other move-in paperwork like a move-in checklist, your list of utility phone numbers like you give your new tenants, these folks may have known the tenant who moved out but have never been listed as a resident and have no occupancy rights. --76.241.xxx.xxx
